Official Rules
1. Please read these Rules. If you do not agree with any of these Rules, please do not access or otherwise use this site. This Contest is sponsored by Oso Sweet® Onions, P.O. Box 1763, Charleston, WV 25326.
2. Contest Eligibility: No purchase necessary to enter or win. Entrants must be at least eighteen (18) years of age and a resident of the United States of America to be a valid contestant in the Contest. Full or part-time employees of Oso Sweet®, affiliates and their immediate family members are not eligible. You must have access to the Internet and a valid email address in order to enter or win. Winning a prize is contingent upon fulfilling all requirements set forth herein. Sponsor reserves the right to verify eligibility qualifications of the winners. Contest is subject to all applicable federal, state, provincial and local laws.
3. Contest Entry/Objective & Criteria: The objective of the Contest is to submit recipes using Oso Sweet® onions as a major ingredient. Each Contest Entry must include a recipe containing a complete list of ingredients, methods/procedures, recipe name, and provide for a serving size of six (6) adults.
4. How to Enter: To enter your Recipe in the Contest, you must complete the Entry Form and then click on the "Submit Your Recipe!" link. You represent that all recipes are original, owned exclusively by you, and you agree that Oso Sweet® may upload your Recipe to our site during the Contest for purposes of promoting the Contest without payment or compensation to you. Oso Sweet® in its sole discretion reserves the right not to upload any Recipe Entry to its site and cancel your participation in the Contest if we determine your Entry violates any of these conditions.
5. Ownership: All recipes submitted to the Contest become the property of Oso Sweet®.
6. Entry Periods: The Contest begins January 11, 2010 at 12:01 a.m. Pacific Standard Time (“PST”) and ends December 3, 2010 at 5 p.m. PST (“Contest Entry Period”). There are four (4) separate recipe contest categories, each with their own entry deadlines. The Super Bowl Recipe Contest begins January 11, 2010 at 12:01 a.m. Pacific Standard Time (”PST”) and ends January 29, 2010 at 5 p.m. PST (”Contest Entry Period”). The Summer Picnic Recipe Contest begins February 8, 2010 at 12:01 a.m. Pacific Standard Time (“PST”) and ends May 14, 2010 at 5 p.m. PST (“Contest Entry Period”). The Tailgate Recipe Contest begins May 24, 2010 at at 12:01 a.m. Pacific Standard Time (”PST”) and ends August 27, 2010 at 5 p.m. PST (”Contest Entry Period”). The Holiday Recipe Contest begins August 30, 2010 at at 12:01 a.m. Pacific Standard Time (”PST”) and ends December 3, 2010 at 5 p.m. PST (”Contest Entry Period”). Each week a winner will be selected. Weekly recipe entries must be submitted before Friday at 5 p.m. PST (“Contest Entry Period”). Entries submitted after Friday at 5 p.m. PST will be automatically enrolled in the following week’s contest. Entries for a particular category submitted after the 5 p.m. PST deadline will be void. You may enter the Contest as many times as you wish provided each Contest Entry is unique and submitted separately.
7. Judging Criteria: Judging will be based on flavor and taste, originality, and the use of Oso Sweet® onion(s).
8. Winner Selection: During each Entry Period, a winning recipe will be chosen. Each weekly winner will be announced on Monday at 11 a.m. Pacific Standard Time (“PST”) on the Oso Sweet® website. The Super Bowl Recipe Contest winner will be announced on February 4, 2010 at 11 a.m. PST. The Summer Picnic Recipe Contest winner will be announced on May 17, 2010 at 11 a.m. PST. The Tailgate Recipe Contest Winner will be announced August 30, 2010 at 11 a.m. PST. The Holiday Recipe Contest Winner will be announced December 6, 2010 at 11 a.m. PST. The Grand Prize Winner will be announced on January 10, 2011 at 11 a.m. PST. Each winning Entry will remain on the site for up to an additional twelve (12) months after which time it will be removed from the site. The winners may be asked to return within ten (10) business days an affidavit of eligibility/publicity or an alternate winner may be selected. All decisions of Oso Sweet® are final.
9. Prizes: The winner for each Weekly Entry Period will receive one (1) Oso Sweet® gift basket. Retail value of prize may vary. There will be one (1) USD$500 prize awarded for the Super Bowl Recipe Contest. There will be one (1) USD$500 prize awarded for the Summer Picnic Recipe Contest. There will be one (1) USD$500 prize awarded for the Tailgate Recipe Contest. There will be one (1) USD$500 prize awarded for the Holiday Recipe Contest. One (1) Grand Prize of USD$2,500. No substitution of prize is allowed. Prizes may not be cashed, transferred or exchanged. We reserve the right to substitute a prize of equal value in the event a prize is unavailable. Unclaimed or undeliverable prizes will not be awarded.
10. Personal Information: The information collected from you is subject to our privacy policy located at http://www.ososweetonions.com/contest/privacy.html. You agree that personal data, such as your name and address, may be stored and otherwise used for the purposes and within the context of this Contest and any other purposes outlined in these Rules. The data may also be used in order to check your identity, postal address and telephone number, or to otherwise verify your eligibility to participate in the Contest and to receive any prize. You have a right to access, review, rectify or cancel any personal data held by Oso Sweet® by sending an email to contestdirector@ososweetonions.com. If your data is not provided or is canceled, your entry will be ineligible.
11. Prohibitions: You agree not to reproduce, download, re-distribute, copy, sell, publish, broadcast or circulate any Recipe Entry (other than your own) contained in the site to anyone. You acknowledge and agree that, except as set forth herein, you have no right to modify, edit, alter or enhance any of the Recipe Entries (other than your own) in any manner.
12. Release; Limitation of Liability: By participating in the Contest, you agree to release and hold harmless Oso Sweet®, Rainmaker Media Group, and including its officers, directors, employees and agents (the "Released Parties") from and against any claim, loss, damage, liability, expense, impairment or cause of action arising out of or related to your participation in the Contest or your receipt or use of any prize. The Released Parties are not responsible for any illegible, incomplete, damaged or inaccurate entries, and/or entries that do not comply with these Rules and/or entries submitted by mail or facsimile. The Released Parties assume no responsibility for entries Oso Sweet® is unable to process due to network, hardware or other technical failures or lost e-mail entries, however caused. To the maximum extent permitted by law, the Released Parties shall not be liable to you or to any third party for any loss or damage suffered as a result of your use, misuse, display, dissemination, replication, distribution, copying or downloading of Contest Entries contained on this site, including but not limited to any indirect, special, incidental, punitive or consequential damages however arising, even if the Released Parties have previously been advised of the possibility of such damage.
13. Other: Oso Sweet® reserves the right to cancel and/or suspend the Contest without liability if any fraud, virus or other technical problem corrupts the security or proper administration of the Contest, as determined by Oso Sweet®. There are no representations, promises or warranties other than those, if any, expressly made herein. Specifically, but not by way of limitation, Oso Sweet, and its agents and assigns, make no representations, promises or warranties of your success or failure by submitting Recipe Entries pursuant to this site and these Rules. There are no implied warranties of merchantability or fitness for any particular purpose and any such warranties are expressly waived by you. Any action related to these terms will be governed by Connecticut law without regard to the choice or conflicts of law provisions of any jurisdiction. You agree to the exclusive jurisdiction of the courts located in the State of West Virginia, U.S.A. for the resolution of all disputes arising from or related to these terms and/or your use of the site. Contest void where prohibited. All federal, state and local laws apply.
14. Contest Results: List of Winners (available at or around the last day of each month of the Entry Period) may be obtained via accessing www.ososweetonions.com. If you would like the names of the winners (available after January 10, 2011), please send a self-addressed stamped envelope by January 1, 2011 to: Oso Sweet 2010 Recipe Contest Winners, P.O. Box 1763, Charleston, WV 25326. Winners’ names will also be posted on the Contest Web Site.
15. General Conditions: Winning constitutes permission (except where prohibited by law) for Sponsor and its designees to use winner’s name, Entry, hometown, likeness, prize won, and photo and video (all at Sponsor’s discretion) for future advertising, publicity in any and all media now or hereafter devised throughout the world in perpetuity, without additional compensation, notification or permission. Contest parties and their respective officers, directors, agents, representatives and employees (collectively, “”Released Parties”) are not responsible for lost, late, misdirected, damaged, stolen, altered, garbled, incorrect, incomplete or delayed Entries or votes; all of which will be void. Released Parties are also not responsible for problems uploading or downloading any Contest-related information or materials from the web site or for any other technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any Entry or vote to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the web site, or for any other technical problems including telecommunication, miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit a contestant’s ability to participate in this Contest. Released Parties are not responsible for any other errors or malfunctions of any kind, whether network, printing, typographical, human or otherwise relating to or in connection with the Contest, including, without limitation, errors or malfunctions which may occur in connection with the administration of the Contest, the processing or judging of Entries, the submitting or tabulating of votes, the announcement of the prizes or in any Contest-related materials. Mass Entries or votes or Entries or votes generated by a script, macro or use of automated devices may, at Sponsor’s sole discretion, be disqualified. Sponsor reserves the right to modify, suspend or terminate the Contest in the event it becomes infected by a computer virus or is otherwise technically impaired, and to cancel or suspend the Contest in its entirety should tampering, unauthorized intervention, fraud, technical failures or other causes corrupt the administration, security, fairness, integrity or proper play of the Contest and, if terminated, at Sponsor’s discretion, determine the winner using all non-suspect, eligible Entries received up to time of cancellation using the judging procedure outlined above. In the event of a dispute regarding Entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of Entry will be deemed to be the contestant and must comply with these Official Rules. Authorized subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses. Sponsor reserves the right at its sole discretion to disqualify any individual (and void his/her Entry and vote) it finds to be tampering with the Entry or voting process or the operation of this Contest or website, intending to annoy, abuse, threaten or harass any other contestant, Sponsor or any of its representatives or to otherwise be acting in violation of these Official Rules. CAUTION: Any attempt by a contestant to deliberately damage any web site or undermine the legitimate operations of the Contest is a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages and other such remedies from any such contestant to the fullest extent permitted by law and to disqualify such contestant from the Contest.
16. Assignment of Rights: Contestant hereby acknowledges that Entry and all other materials of every kind whatsoever created by contestant relating to the Contest (collectively, the “Work”) are a “work made for hire” (as that term is used in the United States Copyright Act) for Sponsor, and Sponsor is the sole and exclusive owner, in perpetuity and throughout the universe, of all right, title and interest in and to the Work, including without limitation all copyrights in and to the Work (and all renewals and extensions thereof now or hereafter provided by law) and all the rights therein and thereto, and may exploit the Work (and all rights therein) in any manner throughout the world without restriction. Without limiting the binding effect of any of the foregoing provisions, in the event that any part of the Work is not deemed to be a “work made for hire” for Sponsor, then contestant hereby irrevocably and exclusively grants and assigns to Sponsor (or, if any applicable law prohibits or restricts such assignment, contestant hereby grants to Sponsor an irrevocable, perpetual, royalty-free, transferable license of) unlimited right, title and interest in and to such Work, including, without limitation, all rights of every kind and nature (whether now known or hereafter devised, including all copyrights therein and thereto and all renewals and extensions thereof), throughout the universe, in perpetuity, for all purposes, in any and all media, whether now known or hereafter devised. By submitting an Entry, contestant acknowledges and agrees that Sponsor may obtain many submissions under this Contest and that such Entries may be similar or identical in theme, idea, format or other respects to others submitted under this Contest and/or other contests staged and/or sponsored by the Sponsor, and waive any and all claims contestant may have had, may have, and/or may have in the future, that any composition, film and/or other works accepted, reviewed and/or used by the Sponsor (or its designees) may be similar to his/her Entry. Contestant acknowledges and agrees that the Sponsor does not have now, nor shall any of them have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to contestant’s Entry.
17. Miscellaneous Conditions: By participating in the Contest, contestants (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and judges, which are final and binding in all matters relating to the Contest. Failure to comply with these Official Rules may result in disqualification from the Contest. Sponsor reserves the right to permanently disqualify any person it believes has intentionally violated these Official Rules and void all associated Entries and/or votes.
18. Releases: By entering the Contest, contestants agree to release and hold harmless Released Parties from all claims, liability or damage caused or claimed to be caused, in whole or in part, directly or indirectly, in connection with participation in this Contest, or acceptance or use of the prize, the substitution of a prize in accordance with these Official Rules, the administration of the Contest, the operation of the website or Released Parties’ use of any of the rights granted herein. Released Parties assume no responsibility for the conduct of any contestant or voter or the responses of anyone appearing in any Entry.
19. Arbitration and Choice of Law: Except where prohibited by law, as a condition of participating in this Contest, contestant agrees that (1) any and all disputes and causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the contestant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will contestant be permitted to obtain awards for, and contestant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than contestant’s actual out-ofpocket expenses (i.e., costs associated with entering this Contest), and contestant further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of contestants and Sponsor in connection with this Contest, shall be governed by, and construed in accordance with, the substantive laws of the United States of America without regard to United States of America choice of law rules.
